These Terms of Service ("Terms") are a binding agreement between you and Are You Faster CIC, a Community Interest Company registered in England and Wales (company number 16536715) ("Are You Faster", "we", "us", "our").

By installing, accessing, or using the Are You Faster mobile application on iOS or Android (the "App") or visiting our website areyoufaster.com (the "Website"), you agree to these Terms. If you do not agree, do not use the App or the Website.

These Terms incorporate our Privacy Policy, available at https://areyoufaster.com/privacy.

1. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you confirm a parent or guardian has reviewed these Terms and our Privacy Policy and agrees on your behalf.

We verify age via a self-declared date of birth at sign-up. If we discover that a user is under 13, we will close the account and delete associated personal data.

2. What the App Does

Are You Faster is a fitness-gamification mobile app that tracks outdoor running and cycling using your device's GPS, lets you race against virtual opponents, and gamifies fitness with achievements, scores, and optional leaderboards. It is provided for personal, non-commercial use.

The App is not a medical device, navigation aid, or substitute for situational awareness or professional advice.

3. Your Account

  • You create an account using Sign in with Apple (iOS only), Sign in with Google, or email and password.
  • You are responsible for keeping your sign-in credentials confidential.
  • One account per person. Do not share or transfer your account.
  • You can delete your account at any time via Settings → Account → Delete Account.

We may suspend or terminate your account if you breach these Terms (see §10).

4. Permissions

To function, the App needs your permission to access:

  • Precise location (foreground and background) — only during active runs. You can revoke this in device Settings; without it the App cannot record runs.
  • Motion / sensor data (iOS) — to optimise GPS accuracy.
  • Apple Health (iOS) or Health Connect (Android), if you opt in — we write completed workouts to your health store; we do not read from it.
  • Notifications — optional, used for run cues and account alerts.

We do not request access to your camera, microphone, contacts, calendar, photos (other than an avatar you choose to upload), or files.

5. Leaderboards and User-Visible Content

Some features make your data visible to other users:

  • Global AYF Score leaderboard — opt-in via Settings.
  • Track leaderboards — when you run a published community track.
  • Weekly challenge leaderboard — when you submit a challenge attempt.
  • Avatar — visible alongside your display name wherever your display name is shown.

You can opt out of the global leaderboard, change your display name and avatar, or delete a track you've published at any time.

6. User-Generated Tracks

When you publish a track, you grant Are You Faster a worldwide, royalty-free, non-exclusive, transferable, sub-licensable licence to host, store, display, reproduce, and modify (for technical purposes such as map-snapping and format conversion) that track's route, name, description, and statistics, solely for the purpose of operating and improving the App.

You retain ownership of your tracks.

You represent and warrant that any track you publish:

  • does not enter private property without permission;
  • is not in a military training area, school grounds, or any area closed to public access;
  • does not cross railway lines outside designated crossings or use motorways or trunk roads;
  • does not infringe any third party's trademark, copyright, or other rights in its name or description;
  • is not designed to harass, identify, or stalk another person.

We may remove a track at our discretion if it violates these Terms, appears unsafe, or a third party reasonably objects. You can delete your own track at any time via Settings → My Tracks.

7. Acceptable Use

You agree NOT to:

  1. Spoof, falsify, or simulate your GPS location or run data (mock-location apps, treadmills, vehicles other than a bicycle in bike mode, public transport, post-hoc data editing).
  2. Use bots, automation, scripts, scrapers, or APIs other than those we explicitly publish.
  3. Manipulate leaderboards, achievements, or scores by cheating, submitting duplicate runs, exploiting bugs, or running multiple accounts.
  4. Reverse engineer, decompile, or disassemble the App, except to the limited extent expressly permitted by applicable law.
  5. Harass, threaten, defame, abuse, or discriminate against other users; impersonate another user, public figure, or business; or submit a display name or content that is offensive, hateful, sexually explicit, deceptive, or that impersonates an account holder.
  6. Attempt to access another user's account, exfiltrate user data, or probe / test our security other than under our responsible disclosure programme at security@areyoufaster.com.
  7. Use the App in a way that violates any applicable law.
  8. Plan or carry out any activity that endangers yourself or others.
  9. Resell, sub-license, redistribute, or commercially exploit the App or its content.

If your content is removed or your account suspended, you can appeal by emailing appeals@areyoufaster.com within 30 days. We do not retaliate against good-faith reports.

8. Health and Safety

The App is a game, not a medical or safety product.

8.1 Consult a doctor before starting any new exercise programme. The App is unsuitable for use during recovery from injury or surgery without medical clearance.

8.2 You exercise at your own risk. Outdoor exercise carries risks of injury, collision, and other harm. You are solely responsible for your own safety, the safety of others, and compliance with the Highway Code and other applicable rules.

8.3 Be aware of your surroundings. Do not look at your phone screen while running or cycling. Keep audio cues at a volume that does not drown out traffic or pedestrians.

8.4 GPS is approximate. Distance, pace, altitude, and route are estimates. Never rely on the App for navigation, safety, or emergency response.

8.5 Routes are suggestions, not instructions. Curated tracks and other route content may pass through areas that have changed since the underlying map data was captured. Inspect any route on a current map and in person before using it.

8.6 Health, calorie, and effort estimates are algorithmic approximations and may differ materially from professional measurement. They are not medical observations.

8.7 The App does not contact emergency services. If you are injured, call your local emergency number (999 in the UK; 112 in the EU; 911 in the US).

You acknowledge that you have read and understood these warnings.

9. Intellectual Property

9.1 The App, the Website, and all associated content — including code, design, layout, graphics, sounds, animations, the AYF logo, the "Are You Faster" wordmark, character designs, the AYF Score methodology, and curated track names — are owned by Are You Faster or our licensors and are protected by UK and international intellectual property law.

9.2 We grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to use the App and the Website solely for personal, non-commercial purposes, on devices you own or control, in accordance with these Terms.

9.3 You may not:

  • copy, modify, distribute, sell, lease, or create derivative works from the App or the Website;
  • remove any copyright or trademark notices;
  • use automated means (scrapers, spiders, bots) to access the App other than as we permit;
  • use any of our trademarks without our prior written consent.

9.4 OpenStreetMap data displayed in the App remains licensed under the Open Database License (ODbL). We display "© OpenStreetMap contributors" where required.

10. Suspension and Termination

10.1 We may suspend or terminate your access at any time, without prior notice, if we reasonably believe that you:

  • have breached these Terms;
  • are using the App fraudulently, abusively, or unsafely;
  • pose a security risk;
  • must be removed by applicable law or a competent authority.

10.2 You may terminate by deleting your account via Settings → Account → Delete Account.

10.3 On termination:

  • the licence granted in §9 ends immediately;
  • your data is handled per our Privacy Policy;
  • §§ 6, 9, 11–17 survive termination.

11. Third-Party Services

The App integrates with third-party services (Firebase, Sign in with Apple, Sign in with Google, Apple Health, Health Connect, OpenStreetMap + OpenFreeMap, MapLibre). We are not responsible for those services, their availability, accuracy, or content. Your use of those services is governed by their own terms and privacy policies.

App distribution is governed by Apple's App Store Terms and Google Play Terms; see also §17 below.

12. Disclaimers

12.1 The App and the Website are provided "as is" and "as available" without warranties of any kind, whether express or implied, including without limitation any implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, completeness, or non-infringement, to the fullest extent permitted by applicable law.

12.2 We do not warrant that the App or the Website will be uninterrupted, timely, secure, free of viruses or harmful components, or error-free, that defects will be corrected, or that GPS data, run statistics, AYF Scores, leaderboard positions, or other outputs will be accurate or reliable.

12.3 You assume sole responsibility for the results obtained from your use of the App.

12.4 UK consumer rights. If you are a UK consumer, nothing in these Terms excludes or limits:

  • our liability for death or personal injury caused by our negligence;
  • our liability for fraud or fraudulent misrepresentation;
  • your statutory rights under the Consumer Rights Act 2015; or
  • any other liability that cannot be excluded under English law.

12.5 EU consumer rights. If you are an EU consumer, nothing in these Terms reduces the protections you have under mandatory consumer law in your country of residence.

13. Limitation of Liability

13.1 Subject to §12.4 / §12.5, to the fullest extent permitted by law:

(a) We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation lost profits, lost revenue, lost data, lost goodwill, or costs of substitute services, arising out of or relating to your use of the App or the Website, even if we have been advised of the possibility of such damages.

(b) Our total aggregate liability for all claims relating to the App and the Website in any 12-month period is limited to the greater of (i) GBP £100 or (ii) the total amounts you have paid us in that period.

(c) We are not liable for harm caused by your reliance on GPS accuracy, route suggestions, distance measurements, pace calculations, AYF Scores, or any other algorithmic output of the App.

(d) We are not liable for the conduct of other users, the content of user-generated tracks, or any consequences of your interactions with other users.

(e) We are not liable for events outside our reasonable control, including acts of God, natural disasters, power or internet outages, satellite-positioning service degradation, acts of governments, war, civil unrest, strikes, pandemic, or the acts of third parties including Apple, Google, or our hosting providers.

13.2 If applicable law in your jurisdiction does not permit the exclusion or limitation of certain warranties or damages, the exclusions and limitations in §12 and §13 apply only to the maximum extent permitted by that law.

14. Indemnification

You agree to indemnify, defend, and hold harmless Are You Faster, its officers, directors, employees, agents, contractors, suppliers, and licensors from and against any claim, demand, loss, damage, cost, or expense (including reasonable legal fees) arising out of or related to:

  • your breach of these Terms;
  • your violation of any law or third-party right;
  • any track you publish or content you submit;
  • your interactions with other users.

This obligation survives termination.

15. Modifications to the App

We may at any time modify, suspend, or discontinue the App or any part of it, with or without notice. We are not liable for any modification, suspension, or discontinuance.

16. Changes to These Terms

For material changes, we will give you at least 30 days' notice via in-app notification and (where we have your email) by email. The "Last Updated" date at the top changes when we revise these Terms. Continued use after the effective date means you accept the new Terms.

17. Apple App Store — Specific Terms (iOS only)

If you download the App from the Apple App Store, you acknowledge that:

(a) These Terms are concluded between you and Are You Faster CIC only, and not with Apple Inc. Are You Faster CIC, not Apple, is solely responsible for the App.

(b) Your licence is limited to use on Apple-branded products you own or control, subject to the Usage Rules in the Apple Media Services Terms.

(c) Apple has no obligation to provide maintenance or support for the App.

(d) In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, who will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation in respect of the App.

(e) Are You Faster CIC, not Apple, is responsible for addressing any claim by you or any third party relating to the App or your possession or use of it (including product-liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims arising under consumer-protection or similar legislation).

(f) Are You Faster CIC, not Apple, is responsible for handling any third-party IP infringement claim.

(g) You represent that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and you are not listed on any US Government list of prohibited or restricted parties.

(h) Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

18. Google Play — Specific Terms (Android only)

If you download the App from Google Play, you acknowledge that the Google Play Terms of Service apply in addition to these Terms. Google is not a party to these Terms. The relationship in respect of the App is between you and Are You Faster CIC, not Google.

19. Governing Law and Jurisdiction

19.1 These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) are governed by, and construed in accordance with, the laws of England and Wales.

19.2 The courts of England and Wales have exclusive jurisdiction to settle any such dispute or claim, except:

  • if you are a UK consumer, you may also bring a claim in the courts of your part of the UK;
  • if you are an EU consumer, you may bring a claim in the courts of your country of habitual residence, and we may bring a claim only in the courts of your country of habitual residence;
  • nothing in this section limits your statutory rights as a consumer in your country of residence.

20. Dispute Resolution

20.1 Informal resolution first. Before bringing a formal claim, please contact legal@areyoufaster.com with a description of your concern. We will try to resolve it informally within 30 days.

20.2 Online dispute resolution. EU consumers may also use the European Commission's ODR platform at ec.europa.eu/odr.

20.3 We do not require binding arbitration or class-action waiver. You retain the right to bring an individual claim in your local courts where the laws of your country permit.

21. Miscellaneous

  • Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and us concerning the App and the Website.
  • Severability. If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect.
  • No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
  • Assignment. You may not assign your rights or obligations. We may assign ours on notice to you, provided the assignee gives substantially equivalent protections.
  • Notices. We give you notice via in-app notification, push notification, or email. You give us notice by email to legal@areyoufaster.com.
  • No third-party beneficiaries except where expressly stated (Apple under §17).
  • Language. The English version of these Terms is the controlling version; any translation is for convenience only.

22. Open-Source Notices

The App incorporates open-source components. The list of those components and their licences is available in the App at Settings → About → Open Source Licences.
